Terms & Conditions

1. General

1.1. These Conditions shall supersede all earlier conditions of Artu.

1.2. These conditions shall take precedence over any conditions of the Customer and shall not be varied without the written consent of a director of Artu.

2. Definitions

2.1. “Artu” means Artu Sculpture Limited.

2.2 “Customer” means the person, firm or company buying or agreeing to buy goods and services from Artu.

2.3 “Price Paid” means the price paid by the Customer for the Product excluding carriage and any credit surcharge. The Price Paid is stated on the Order Confirmation.

2.5. “Order Confirmation” means the acknowledgement of the Customer´s order sent to the Customer by Artu.

2.6. “Product” means any commissioned works of sculpture or bespoke jewellery supplied to the Customer by Artu.

3. Prices

3.1 Prices for Bespoke Jewellery Products are quoted, in Pounds Sterling, on the Site and are inclusive of UK delivery costs. The price payable by the Customer will be the price current at the time of the order.

3.2 Prices for Portrait Sculpture Commissions will vary according to the nature of the commission but will be agreed in writing prior to commencement. UK delivery costs, or, where applicable, the delivery costs of the country where Products are to be delivered, are outlined during the payment processing stage.

3.3 Artu reserves the right to withhold the Products and/or terminate this Agreement if the final total price is not received from you in full, on time, in cleared funds.

4. Terms of Payment

4.1 Payment for Artu Bespoke Jewellery Products unless otherwise agreed is due in full upon the placement of your order in cleared funds. A detailed invoice will be mailed to you following Artu’s receipt of payment in full, on time, in cleared funds.

4.2 Payment for Artu Portrait Sculpture commissions is due based upon the following payment schedule; 30% with written confirmation of the commission, 40% on approval of digital model, 30% on delivery.

5. Delivery

5.1 Delivery of Products will be made using Royal Mail Special Delivery service or other appropriately insured courier.

5.2 Artu will arrange for the Products to be delivered to the address for delivery indicated in your Order.

5.3 Artu will arrange for original life casts to be returned to you with the Products ordered to the address for delivery indicated in your Order. Original life cast will be insured for loss or damage during delivery up to a value of £500 unless otherwise agreed.

5.4 An estimated delivery date will be provided to you upon the placement of your order. However, we cannot guarantee delivery by the relevant date.

6. Risk and Property

6.1 The Products will be at your risk from the time of delivery.

6.2 Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

6.3 Ownership of original casts you may provide to be used by Artu to create Miniature Life Cast Jewellery Products shall remain with you.

7. Defective Products and Return Policy

7.1 Product Orders accepted and approved by Artu are final. You may not cancel this Agreement at any time, unless Products supplied are defective or in unsatisfactory condition.

7.2 If Products are received defective and/or in unsatisfactory condition, you must inform Artu via telephone within 48 hours, and again in writing within 7 business days upon receipt of Products. Products must then be returned to us immediately, in the same condition in which you found them.

7.3 Any Products returned to Artu, for any reason, at any time, must be returned in the original packaging –or its directed equivalent– and transported by an appropriately insured courier or postal service.

7.4 If you do not inform Artu of your defective or unsatisfactory Products within 48 hours (via telephone) and again within 7 business days (in writing) upon the receipt of your Products, Artu shall no longer bear liability to you for the defective or unsatisfactory Products.

7.5 Where notification of defective or unsatisfactory Products is received within due times, Artu may:
1. replace the damaged Products with those of satisfactory quality; or,
2. offer you a full refund or
3. if both parties agree, supply you with a replacement or substitute Product.

8. Refunds

8.1 If you are entitled to a refund, Artu will refund your payment via credit, debit, and/or banking card.

8.2 Artu agrees to process the refund due to you as soon as possible and, in any event, within 30 days upon receiving your written notice of cancellation.

9. Warranty and Liability

9.1 Images of Products on the Artu website are for illustrative purposes only; actual Products may differ from such images. All Rights to images displayed on the website or used in any promotional materials are owned by Artu and cannot be used without prior written permission from Artu Sculptures Ltd.

9.2 Artu warrants to you that any Products purchased from this Site will be of satisfactory quality.

9.3 You nor Artu shall remain liable to one another, nor shall either party be determined to be in breach of this Agreement if delays in or failures of performance or obligations ensue due to causes beyond reasonable control. Causes beyond reasonable control of both parties include:
a) Hurricane, tsunami, explosion, flood, tempest, fire or fatal or near-fatal accident;
b) Act of terrorism, war, threat of sabotage, insurrection, or civil disturbance; and,
c) Acts, restrictions, bye-laws, prohibitions or measures of any kind or part of any governmental, parliamentary, state, city, or local authority.

9.4 Artu agrees to advise and/or assist any and all Customers with any subject relating to the correct usage, cleaning, storage, or repair of any of its Products.

10. Customers Obligations

10.1. You are responsible for your own choice of Product and the suitability for any particular purpose.
10.2. Images are for illustration purposes only.

10.3. You must provide reasonable courtesy information and co-operation to Artu.

11. Copyright

11.1 Copyright of Artu Products purchased or commissioned by Customers shall be retained by Artu.

11.2 Customers shall not make copies of or commission or permit anyone else to make copies of Artu Products without the express written consent of Artu.

9. Privacy Policy

9.1 Artu agrees to treat all your personal information collected in connection to your Order in accordance with the terms of our Privacy Policy.

10. Governing Law

10.1 This Agreement and the performance of both parties will be governed by and interpreted in accordance with the laws of the England.

10.2 English courts shall have exclusive jurisdiction with respect to any dispute arising under this Agreement.

11. Indemnity (Third Parties)

10.1 You shall indemnify Artu against all claims made against Artu by a third party in respect to Products supplied by Artu.

12. Severability
12.1 If any provision of this Agreement is found to be illegal, void, or unenforceable, the remaining provisions shall remain in full force and effect, and such invalid provisions shall be severable or omitted from the remaining portions of this Agreement.

Privacy Policy

Artu is committed to ensuring that your privacy and any personal information you provide when using this website is secure and protected.

Cases where, upon our request, you may choose to voluntarily provide us with your personal information, include:

a) when ordering/purchasing any of Artu’s products or services; or,

b) when enquiring about any of Artu’s products or services.

Any of your personal information willingly provided to us is used exclusively by Artu.

Artu reserves the right to store the personal information you willingly provide for:
a) our internal record keeping; and,

b) for providing you with current and future information about our products and services.

Any of your personal information collected via this website, email, or in-person will be used solely by Artu in accordance with the Data Protection Act 1998. Artu will not sell, distribute or lease your personal information to third parties unless required to do so by law.

You have a right to know what personal information Artu retains about you, and a right to correct or alter said information. You also have a right to reasonable consumer access to information or protections against accidental or unauthorized alteration.
